Small Claims Court

For human rights matters that occur within Ontario’s provincial jurisdiction, the Ontario Human Rights Code applies.
Individuals can bring applications before the Ontario Human Rights Tribunal – HRTO.

The HRTO has no momentary limit on claims submitted to the HRTO.
The HRTO generally awards between $5,000 to $25,000 for injury to dignity and self-respect
The HRTO cannot award court costs.
You have one year from the realization of the last known incident to bring a claim before the HRTO. There are some rare incidents where this time limit can be waived.
Presently, the delays before the HRTO are extremely excessive where applications can take between five and ten years to be heard!
Currently the HRTO has a 97% summary dismissal rating, where the HRTO is dismissing claims without a hearing based on an alleged lack of jurisdiction.
